To ensure the Community remains relevant and organized, while fostering a friendly and supportive ambiance, we kindly ask you to acquaint yourself with the Community's Terms of Use for the Forum ("Terms & Conditions'') and adhere to them when contributing to the Forum. Members who do not adhere to or breach the Terms & Conditions may face temporary suspension or removal from the Nothing Community, and their content may be taken down. Nothing hereby relinquishes all responsibility for posts that infringe upon the listed Terms & Conditions below. Please read the undernoted Terms & Conditions carefully before you decide to use and participate in the Forum (“Participant(s)” “you” or “yours”, as the case may be). Nothing may change these Terms & Conditions at any time by posting new or amended conditions on this page at its sole discretion and without any liability. Please, therefore, check regularly and make yourself fully aware of our conditions before using the Forum. Participating in the Forum made hereunder is at your own risk and cost.

 

This Forum is operated and maintained by Nothing Technology Limited (along with its affiliates, “Nothing”).     

 

1. Eligibility and Forum Entry:

 

The Forum is available for usage and participation on the following eligibility criteria:

 

1. be a natural person of at least eighteen (18) years in age as on the date of usage/participation(or older if required in your country of residence);
2. the Participantneeds to create an account on the Forum by filling in the the relevant information;

• all the personal datashared on the Forum shall be treated in accordance with the Privacy Policy posted on the website;

1. One account per person. Participants found to be using multiple accounts may have all accounts banned and/or removed. This includes accounts created to circumvent bans. Similarly, accounts impersonating staff, other Participants, or public figures will also be banned and removed.
2. Except in their roles as administrators, employees (including immediate family members) of Nothing, its affiliates, and agents and are not permitted to participate in the Forum.

 

2. Specific Representations and Warranties:

 

Each Participant represents and warrants that:

 

• his/her participation is voluntary with his/her own free will and consent and he/she is not forced to use this Forum.

 

• he/she and any other individual who have contributed in any manner in his/her contributions tothe Forum, have read, and accepted these Terms and Conditions.

 

• that he/she, along with anyother contributors to the Forum on his/her behalf will comply with all the Rules associated with the Forum including but not limited to the Terms & Conditions mentioned herein and the Participant shall be liable for any breach(es)/violation(s)/non-compliance.

 

• the Participantwill ensure that whatever is posted on the Forum is and will be in adherence and compliance to all the community guidelines, rules, terms, policy that have been published by the Forum, along with any additions, modifications, renewals, revisions to the Forum Terms & Conditions that may come into existence in the future. Nothing shall not be responsible, questioned, or made liable for any acts in its moderation of the Forum, which may in addition to other actions, include termination, temporary or permanent suspension or take down of the Account and/or deletion/removal and/or take down of the posts on the Forum.

 

• the posts made by the Participantshall:

 

1. refrain from using inappropriate language, including content that is sexually explicit, violent, or offensive in nature.
2. display respect and tolerance towards all members of the community, promoting a positive and inclusive environment.

• keep in mind that discussions related to religious, racial, or political beliefs are not within the purview of this Community and should not be shared.

1. avoid engaging in "doxxing" or making threats to reveal personal details of other Participant Itis recommended that Participants not share personal data which they wish not to be public on the Forum platform.
2. not contain any malware, phishing websites, or any content that could potentially harm others. Such content will be removed, and accounts associated with it will be permanently banned.
3. refrain from any form of automated activity that may disrupt the natural interactions within the community.

• only share third-party intellectual property if you have explicit written permission to do so. This includes trademarks, copyrights, trade secrets, and personality rights.
• not be obscene, vulgar, defamatory towards women, artists, celebrities, or children.

1. not defame/offend any person, sect, cast, etc. it shall not be obscene, vulgar, defaming, denigrating women, artists, celebritiesor children, hurting religious sentiments, blasphemous, depicting violence, or against the public policy of India or/and the internal policies of Nothing.
2. not contain content that depicts alcohol,tobacco, drugs, pornography, or anything illegal. Posts shall not in any manner depict or encourage harm or injury to any person, party, or animal.
3. refrain from posting any content which advertises, markets, offers for sale, or sells any products, including, without limitation, any discount codes, product advertisements, or links to product pages.

 

If you find content that may fit the description above, do not engage with another Participant posting it, even if you are the one being targeted. By responding to this type of content, you may inadvertently also break these Rules. Instead, report such activity to the Nothing team members moderating the Forum.

 

3. General Terms & Conditions:

 

• Participants acknowledge that they do not have any medical, physical and/or emotional condition which can jeopardize their eligibility for using or participating on the Forum.

 

• The Participantacknowledges that Nothing shall not be liable for any mishap, injury, accident, untoward incident, physical harm of any nature, death, loss of life or limb, etc., caused to them, during or after usage of the Forum; and no such accident (etc.) will be attributed to Nothing and Nothing shall not be held responsible for the same nor shall the Nothing be liable to indemnify or make good any claim being raised against it, for whatsoever nature.

 

• Participants acknowledge that access to the Forum may not be available at all times and that the Forum may be subject to outage, failure, maintenance shutdowns, and/or closure. Nothing, its affiliates, agents, and assigns shall not be responsible for any such lack of availability of the Forum.

 

• The personal dataof the identified Participant ("Personal Data", as defined in Sub-section 3(k)) shall be provided by Nothing to the extent allowed by law, to others assisting Nothing in this regard, including its affiliates, associates, authorities, agents, sponsors, employees, distributors, deliverers and service providers (as applicable). Additional details regarding personal data may be found in Sub-section 3(k).

 

• It is the Participant’s responsibility to ensure that their Personal Datais always updated and accurate.

 

• Nothing reserves the right to request proof of a Participant’s eligibility if there is any doubt regardinghis/her eligibility for

 

• The Participanthereby agrees and undertakes that he/she shall not accept or undertake to accept/give or undertake to give, either directly or indirectly, any gifts, commission or other favours, of any kind whatsoever, to facilitate their promotion on the Forum. Any knowledge of such an act shall lead to immediate disqualification of such Participant and Nothing shall be entitled to take any/all actions against such Participant(s), as reasonably deemed fit.

 

• By using the Forum, the Participantalso agrees that, in using the Forum, they shall solely be liable for any and all actions (criminal/civil) arising therefrom. The Participant shall indemnify and hold harmless Nothing, its affiliates, successors, and assigns and their respective officers, directors, employees, agents and representatives against any losses, damages, expenses, liabilities, claims, disputes, disrepute, or disruption caused to the indemnified parties, including reasonable attorney fees, arising from or relating to the Participant’s participation in the Forum.

 

• By using the Forum, the Participantagrees to be bound by any rules, regulations, guidelines or policies ("Rules") associated with the Forum, including any reasonable instructions from Nothing, and agrees to be bound by any decisions made by Nothing, including any interpretations of such Rules by Nothing.

 

• The Terms and Conditions of and in relation to this Forum, as stated herein, constitutean electronic record under the terms of India’s Information Technology Act, 2000 ("Act") and rules thereunder as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology (Amendment) Act, 2008. This is a legal and binding agreement between the Participant and Nothing, that states the Terms & Conditions that govern the Participant’s engagement with the Forum. By posting on the Forum, the Participant agrees to having read and understood the Terms & Conditions and hereby unconditionally consents, agrees and undertakes to abide, be bound by, and adhere to the Terms & Conditions stated herein.

 

• Personal Data. By participating in the Forum and sharing any other personal data, Participants are expressly consenting to the processing of their personal data by Nothing for the purpose of the Forum or any associated publicity by Nothing or its affiliates. Nothing’s Privacy Policy shall apply. Nothing may share relevant Forum information with partners and authorised licensees for Forum administration and related purposes.

1. The Participant consents to his/her Personal Data being transferred, stored (both electronically and manually) by Nothing to Nothing and its business partner(s) located outside of the European Economic Area or area of residence for the purposes of maintaining records of the Forum and developing Forum-related external marketing materials. The Participant hereby agrees that such usages shall constitute legitimate business needs for Nothing.
2. The Participant further acknowledges and agrees that his/her participation in any Forum contests may result in his or her name, social media handle and other personal data (“Personal Data”, as defined below) being announced publicly. The Participant hereby waives any and all objections to such disclosures in such contest-related materials.
3. For the purposes of this Agreement, “Personal Data” may include, depending on the circumstances and without limitation, the following: email address, name, birthdate, passport or ID number, home address, contact information, social media handle, forum ID, region of residence, likeness, or appearance. Nothing and its partners shall only retain the Participant’s Personal Data only as long as it may be needed.
4. The Participant acknowledges that collection and processing of the Personal Data listed herein for the uses described herein shall constitute a legitimate business need of Nothing.
5. Nothing undertakes to ensure that it and its partners will take appropriate measures to protect Participants’ Personal Data and use Participants’ Personal Data only for the purposes described in this Agreement. Both Data Controller(s) and Data Processor(s) shall sign data processing agreements (DPAs) to meet the European Union’s requirements with respect to data processing.

 

• Limitation of Liability. Under no circumstances shall Nothing and/or its parent, subsidiaries, associates, affiliates and group entities, and their respective directors, employees, officers, agents or representatives be liable to the Participants or any third party for any lost profits or lost opportunities, indirect, special, consequential, incidental, or punitive damages whatsoever, even if Nothing has been advised of the possibility of such damages. The Participants specifically agree not to file in person/through any family member and/or any third party, any applications, criminal and/or civil proceedings in any courts or forum in India or any other jurisdiction against Nothing, its parents, subsidiaries, associates, affiliates and group entities, and their respective directors, employees, officers, agents or representatives to claim any damages or relief in connection with the Forum.

 

• Updates/Changes to Terms. Nothing may, at any time, at its discretion, close the Forum, change these Terms & Conditions or the Rules mentioned herein, without prior notice, and the Participant acknowledges that such change shall be final, binding and irrevocable upon them.

 

• The invalidity or unenforceability for any reason of any part of these Terms & Conditions shall not prejudice or affect the validity or enforceability of the remaining parts and each part of these Terms & Conditions is distinct and at all times severable from the rest of the Terms & Conditions.

 

• No waiver of any rights by Nothing will be taken as a waiver of any other rights it may have. For instance, if Nothing waives its right to object to a particular breach of these terms and conditions by a Participant, it does not preclude Nothing from objecting to any other breaches by the Participant and/or or any other /Participant.

 

• Dispute resolution.Unless your jurisdiction requires mandatory application of local law, these Terms & Conditions shall be governed by the laws of England and Wales, without regard to conflict of law provisions. The courts of London shall have exclusive jurisdiction.

 

• Non-discrimination.Nothing operates this Forum in accordance with all relevant equality and anti-discrimination law (whether in relation to race, nationality, sex, gender reassignment, age, disability, sexual orientation, religion or belief, pregnancy, maternity or otherwise).

 

• Relationship between the Parties.Notwithstanding anything to the contrary contained in these Terms & Conditions, the relationship between you and Nothing is on a principal-to-principal basis and nothing in this Agreement will be construed as creating a partnership, joint venture, association of persons, or employment/agency relationship between the Parties. You shall not have any right to obligate or bind Nothing, or vice versa, in any manner whatsoever. Nothing contained in this Agreement shall give any rights of any kind to any third parties, whatsoever.

 

• Entire Agreement.These Terms & Conditions, together with any and all exhibits, annexures, and schedules, or amendments made by Nothing in writing, constitutes the entire understanding and agreement in relation to the subject matter hereof and supersedes all other agreements, understandings and representations made by either Party, prior to execution of this Agreement, whether verbal or written.  

 

• Participants’ usage of the Forum shall be strictly in compliance with applicable laws and regulations. Forum Participants must comply with all relevant laws and regulations at all times. Due to sanctions and other legal restrictions, Nothing’s services—including participation in any Forum contests—may not be available in all countries or regions.
